These Terms and Conditions ("Terms") govern your access to and use of our website: at-say.com (the "Site"), and the services provided through our software-as-a-service platform (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

By creating an account, accessing, or using the Service, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and agree to these Terms. Your continued use of the Service after such updates constitutes acceptance of the revised Terms.

at-say provides access to cloud-based social media site designed to help Christians enjoy online conversations free from divisive content such as politics, pornography, and interdenominational fighting. The Service is provided on a subscription basis and is subject to the features, limitations, and pricing outlined on our Site.

 3. Account Registration

·      Account Creation: To use the Service, you must register for an account and provide accurate, complete, and current information.

·      Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at support@at-say.com if you suspect unauthorized use.

·      Eligibility: The Service is not intended for use by individuals under 18 or entities prohibited by applicable law.

 4. Subscription and Payment

·      Subscription Plans: Access to the Service is provided through paid subscription plans as described on the Site. Features and pricing may vary by plan.

·      Billing: You agree to pay all fees associated with your subscription (where this is applicable). Fees are billed in advance on a recurring basis (e.g., monthly or annually) and are non-refundable except as required by law or stated in our refund policy.

·      Payment Authorization: By providing payment information, you authorize us to charge your chosen payment method for all applicable fees.

·      Price Changes: We may adjust subscription fees at any time. We will notify you at least 30 days in advance of any price increase, and the new pricing will apply upon your next billing cycle.

·      Your Content: You retain ownership of any data, content, or materials you upload to the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process it solely to provide and improve the Service.

·      Feedback: Any suggestions or feedback you provide about the Service may be used by us without obligation to you.

8. Termination

·      By You: You may cancel your subscription at any time via your account settings. No refunds will be provided for the unused portion of your billing cycle, except as required by law (e.g., under GDPR or CCPA).

·      By Us: We may suspend or terminate your access to the Service if you violate these Terms, fail to pay fees, or for any other reason at our discretion, with or without notice. For EU residents, termination will comply with GDPR requirements for lawful processing.

·      Effect of Termination: Upon termination, your right to use the Service ceases, and we may delete your User Content after a reasonable period unless otherwise required by law (e.g., GDPR data retention obligations).

 9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure. For EU residents, this disclaimer does not affect statutory rights under applicable consumer protection laws.

 10. Limitation of Liability

To the maximum extent permitted by law, at-say and its affiliates, officers, directors, and employees will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. Our total liability to you will not exceed the amount you paid us in the 12 months preceding your claim. For EU residents, this limitation does not apply to damages caused by gross negligence or wilful misconduct where prohibited by law.

 11. Indemnification

You agree to indemnify and hold at-say harmless from any claims, losses, or damages, including legal fees, arising from your use of the Service, your User Content, or your violation of these Terms. This applies to the extent permitted under GDPR and CCPA.

 12. Governing Law and Dispute Resolution

·      Governing Law: These Terms are governed by the laws of United Kingdom, without regard to conflict of law principles, except where GDPR or other local laws mandate otherwise for EU residents.

·      Dispute Resolution: Any disputes arising from these Terms will be resolved through binding arbitration in London, conducted under the rules of UK arbitration. Either party may seek injunctive relief in a court of competent jurisdiction. For EU residents, you may also resolve disputes via your local courts, or an alternative dispute resolution body as required by law.

·      Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration, where permitted by law.

 13. Miscellaneous

·      Entire Agreement: These Terms, along with the Privacy Policy and any additional agreements (e.g., subscription terms), constitute the entire agreement between you and at-say.

·      Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

·      Assignment: You may not assign these Terms without our consent. We may assign them at our discretion.
